Q: I'm trying to understand how ecommerce tax works and make sure that I'm doing this correctly. Is the tax charged to the customer based on:

  • where they live?
  • where the recipient lives?
  • where the business is located?

Here's the scenario in question: I'm based in Oregon, but I have a warehouse in Texas. An Oregon customer placed an online order that is shipping to Austin, TX. She was charged Texas sales tax. Should that happen?

A: You are talking about "nexus." Generally, sales tax is based on the recipient's location, not where the customer or the business is located. But it depends on how much you sell in each state. You may be interested in using software like TaxJar to make sure they're compliant with each state's nexus laws.
